At the Marquette Lawyer, Judge Jeffrey Sutton: Barnette, Frankfurter and Judicial Review.  (This article is an edited version of Judge Sutton's  2012 E. Harold Hallows Lecture at Marquette University Law School).

Judge Sutton, a former clerk to Justice Scalia and a judge on the U.S. Court of Appeals for the Sixth Circuit, might well be on a short list for the Supreme Court in a Romney administration, if there is such a thing (and his opinion rejecting the constitutional challenge to the health care reform might make him more palatable to Democrats than some other candidates).
